Milimani High Court Suspends Police Ban on Nairobi CBD Protests

The court issued a temporary order restraining the Inspector General of Police and any other officers serving within the National Police Service from enforcing the July 17, 2024 ban.

The Milimani High Court has intervened in the ongoing dispute over protests in Nairobi’s Central Business District (CBD) by issuing a conservatory order to suspend the recent ban imposed by the police.

Justice Bahati Mwamuye issued the order on Thursday, July 18, 2024, following a petition filed earlier that morning challenging the ban.

The court’s decision temporarily halts the enforcement of the ban pending the determination of the petition.

It also includes a temporary order restraining the Inspector General of Police and all officers within the National Police Service from enforcing the ban issued on July 17, 2024.

“In view of the pending inter-partes hearing of the Application dated 18/07/2024, a conservatory order is hereby issued restraining the Inspector-General of Police and all other persons serving within the National Police Service from applying or enforcing the impugned decision,” Justice Mwamuye ruled.

The court further directed Acting Inspector General Kanja to disseminate official communication regarding the orders to all officers within the National Police Service and to the general public by the end of Friday, July 19, 2024.
