The High Court has directed Sarah Wairimu, a suspect in the murder of her husband, Tob Cohen, to remain in custody at Lang’ata Women’s Prison until Wednesday, January 29.
In a ruling delivered on Friday, January 24, Kibera Law Courts Judge Diana Kavenza stated that both the prosecution and defense had presented detailed submissions that required additional time to thoroughly address.
Judge Kavenza also indicated that she would decide whether Wairimu must undergo a mental health evaluation before entering a plea for the murder charges.
“The submissions presented by both parties raise significant legal issues that need to be addressed comprehensively. I intend to prepare a detailed report covering all the legal arguments raised.
Consequently, the accused shall be remanded at Lang’ata Women’s Prison and brought to court on January 29,” the judge ruled.
Wairimu was rearrested on Thursday evening in connection with the murder of her husband, Tob Cohen, which occurred between July 19 and July 20, 2019, at their home in Lower Kabete.
The Director of Public Prosecutions (DPP) issued a statement explaining that Wairimu’s rearrest followed the discovery of compelling new evidence directly linking her to Cohen’s murder. The DPP revealed that fresh material evidence had been handed over to the Directorate of Criminal Investigations (DCI), prompting the termination of an earlier inquest into the murder and the filing of new charges against Wairimu.
“The Office of the Director of Public Prosecutions remains committed to fulfilling its mandate while upholding the public interest, ensuring justice, and preventing the misuse of legal procedures,” the DPP emphasized in a press release.
Cohen, who had been reported missing in July 2019, was discovered dead two months later. His body was found in September 2019, concealed in a septic tank at the couple’s residence.
