13 Police Officers and an NIS Agent Charged With Murder in Kiambu Court
Thirteen police officers and an agent from the National Intelligence Service (NIS) have officially been charged with murder at the Kiambu High Court.
The officers, along with a Kenya Wildlife Service (KWS) warden, are accused of being involved in the killing of two Indian nationals and a Kenyan taxi driver in Nairobi’s Ole Sereni area in July 2022.
According to court documents released by the Office of the Directorate of Public Prosecutions (ODPP), the suspects were charged with the murder of Mohammed Zaid Sami Kidwali and Zulfiqar Ahmed Khan—both Indian nationals—and Nicodemus Mwania Mwange, a Kenyan taxi driver.
The court heard that the three victims were abducted and killed on the night of July 22 to July 23, 2022, near Ole Sereni Hotel along Mombasa Road, Nairobi.
The prosecution stated that the accused, together with other individuals who are not yet before the court, carried out the abduction and subsequent murder.
The prosecution has been instructed to submit its objections regarding the bail application, while a probation officer has been directed to compile a pre-bail report. This report will include statements from the victims’ families in both Kenya and India to determine whether bail should be granted.
All the accused, who were previously members of the now-disbanded Special Service Unit (SSU) under the Directorate of Criminal Investigations (DCI), NIS, and KWS, pleaded not guilty to the charges before Justice Abigael Mshila.
The case, which has been under investigation for years, has now reached a crucial stage in court. The defense team, led by lawyer Danstan Omari, strongly opposed the prosecution’s claims, stating that the case was politically motivated and meant to persecute the accused officers unfairly. The defense further urged the court to grant bail, emphasizing that one of the officers had been in custody for over 18 months without release.
The court has scheduled the case for mention on March 20, 2025, when directions will be given, including a ruling on the bail application.
Reports indicate that the SSU officers allegedly abducted the two Indian nationals and their taxi driver just weeks before Kenya’s 2022 General Elections.
The two foreigners were reportedly involved in supporting President William Ruto’s campaign efforts at the time. Their disappearance sparked an investigation soon after President Ruto ordered the disbandment of the controversial police unit, which had been attached to the DCI.
