Maraga Warns President Ruto That ICC Might Return to Kenya Over Protest Killings
Former Chief Justice David Maraga has issued a strong warning to President William Ruto, saying the International Criminal Court (ICC) could soon return its focus to Kenya because of the ongoing politically motivated demonstrations and related violence.
Speaking during a press briefing on Monday, July 7, Maraga accused President Ruto of making dangerous and irresponsible statements during a time of growing political tension.
He said that such actions have not gone unnoticed and are now drawing the attention of the international community, especially the ICC, which previously investigated Kenyan leaders after the 2007 post-election violence.
Maraga stressed that if the ICC decides to open a fresh investigation, this time they may have enough solid evidence and credible witnesses to successfully prosecute the president and other senior officials.
He added that the international community is closely watching Kenya, especially given the growing number of deaths reported during the recent protests.
“I will not be surprised if the ICC returns to Kenya,” Maraga stated. “The last time they came, they lacked witnesses and enough proof, but this time it’s different.
These people are not stupid. If they start investigating, they’ll do a thorough job and may come back with a strong case,” he added.
He went on to say that what is being aired by international news outlets paints a worrying picture of Kenya’s current situation. “The whole world is shocked.
We are not in a war zone, yet in less than one month, over 60 people have been killed, and we continue to hear reckless statements from the president himself. That is far from normal,” Maraga warned.
Maraga, who has publicly announced his plan to run against President Ruto in the 2027 general elections, also criticized the president’s leadership.
He said Ruto has failed to deliver on the promises he made before the 2022 elections, and this has left many Kenyans disappointed. According to Maraga, even national dialogue won’t be enough to rebuild the trust the president has lost.
Maraga’s remarks came just two days after former Deputy President Rigathi Gachagua made similar statements while speaking to Kenyans living in the United States on Friday, July 11.
Gachagua revealed that he has already put together a team of experts to collect evidence and build a case against President Ruto that will be taken to the ICC.
Gachagua said the case will not only revisit the previous ICC charges related to the 2007 post-election violence—which were not fully concluded—but will also include new evidence related to recent killings, enforced disappearances, and human rights abuses allegedly carried out by security forces during the current anti-government protests.
“I want to assure Kenyans that I have established a team to record and organize all the atrocities, including killings, forced disappearances, abductions, and internal displacements happening in the country,” Gachagua explained.
He emphasized that this time, they are being extra careful to ensure there are no errors or missing links that could cause the case to collapse. “We are gathering solid evidence that will be submitted to the ICC to charge William Ruto at The Hague,” he said.
Both Maraga and Gachagua’s comments reflect the growing political divide in Kenya, with increasing calls for international intervention as the number of casualties and reports of human rights violations continue to rise amid widespread demonstrations.
