Former MP Silas Mwaita Arrested Over Land Fraud Allegations
Former Baringo Central Member of Parliament, Silas Komen Mwaita, was arrested on Sunday, August 3, over serious allegations involving land fraud and abuse of office. The Directorate of Criminal Investigations (DCI) confirmed his arrest, stating that detectives apprehended him in Kilimani, Nairobi.
According to a statement from the DCI, Mwaita and one of his associates had been under investigation for some time, with evidence pointing to a conspiracy to commit a felony.
The charges stem from a suspicious land deal involving two highly valuable parcels of land located along Mai Mahiu Road in the Nairobi West area. The properties are estimated to be worth millions of shillings.
The DCI stated, “Detectives have today arrested Hon. Sammy Silas Komen Mwaita at Kilimani for offences including conspiracy to commit a felony, making a document without authority, abuse of office, and giving false information to a public officer.” These charges highlight the seriousness of the case, which has now drawn national attention.
The arrest came after the Office of the Director of Public Prosecutions (ODPP) recommended that Mwaita be taken into custody.
The ODPP reportedly reviewed evidence linking him to the alleged crimes and concluded that there was enough justification to proceed with legal action.
Silas Mwaita’s name is not new in corruption and land-related controversies. He first entered Parliament in 2007, representing Baringo Central Constituency.
Even before becoming a lawmaker, Mwaita served as a long-time civil servant and notably held the position of Commissioner of Lands from 2000 to 2003, during the final years of President Daniel arap Moi’s administration.
Since leaving active politics, Mwaita has faced several legal troubles. In 2022, he was summoned by the Ethics and Anti-Corruption Commission (EACC) over accusations that included abuse of office, conflict of interest, and the fraudulent acquisition of public property.
At the time, the EACC was investigating his alleged involvement in irregular land transactions during his time as Lands Commissioner.
In yet another case in 2024, Mwaita’s name resurfaced in a controversial land dispute that the EACC was actively pursuing.
This particular case involved the recovery of a prime piece of land in Kakamega County, which had reportedly been allocated improperly when Mwaita held his role as Lands Commissioner.
The EACC stated that the land had been grabbed and was being reclaimed as part of its ongoing efforts to recover public assets.
Mwaita’s recent arrest marks the latest chapter in a long history of allegations surrounding his time in public service.
As investigations continue, both the DCI and ODPP have promised to ensure that justice is served, and that those involved in corruption and abuse of office face the full force of the law.
