EACC Arrests Kisii County Assembly Official Over Fake Documents

An administrative officer working at the Kisii County Assembly has been arrested and taken to court after investigations revealed that he allegedly used forged documents to secure employment. The arrest was made by the Ethics and Anti-Corruption Commission (EACC), which has been following up on the case.

According to the EACC report, the officer tampered with crucial identification documents to hide his real identity and true age. Investigators say he altered his birth certificate by changing his year of birth from 1967 to 1973. With this new false information, he was able to obtain a national identity card that carried fake details.

The scandal did not stop there. The suspect is also accused of forging several other key documents, including a Kenya Revenue Authority (KRA) PIN, a National Hospital Insurance Fund (NHIF) card, and a National Social Security Fund (NSSF) card.

All these forged papers were made to match the fake year of birth and identity, and they were later submitted to the Kisii County Assembly as part of his job application.

After investigations were completed, EACC handed the file over to the Office of the Director of Public Prosecutions (ODPP).

The ODPP reviewed the evidence and recommended that he face prosecution. The approved charges included one count of deceiving a government principal, five separate counts of forgery, and five counts of presenting fake documents as genuine.

Court documents presented by the ODPP showed that in official government employment forms — the Public Service Commission application (PSC.2 Revised 2007) — and in his Declaration of Income, Assets, and Liabilities under the Public Officer Ethics Act (2003), the accused stated that he was born on February 15, 1973. However, records showed that he was actually born in 1967.

The court further heard that on December 2, 2015, he presented forged documents, which included a national ID card, birth certificate, KRA PIN certificate, NHIF card, and NSSF card. All of them indicated 1973 as his year of birth instead of the true 1967.

Following his arrest, the officer was processed at the EACC South Nyanza Regional Office and later held overnight at Kisii Central Police Station.

The next morning, he was brought before the Kisii Anti-Corruption Court, where Senior Principal Magistrate Bernard Omwansa presided over the case.

During the court session, prosecutors stressed the seriousness of the case, pointing out that altering personal details to gain government employment undermines public trust and damages the credibility of the Public Service.

The officer, however, denied all charges. He was released on a bond of Ksh150,000 with a surety of the same value or alternatively, a cash bail of Ksh70,000.

The court has scheduled a pre-trial conference for September 25, 2025. On this date, both the prosecution and the defense are expected to give their plans on how the case will proceed.

The ODPP offices in Nairobi confirmed that the matter is officially underway and will be closely followed as part of the government’s commitment to fight corruption and forgery in the public sector.
