73-Year-Old Dutch National Sentenced and Fined in Kenya for Child Abuse Crimes

A 73-year-old Dutch man has been sentenced to 10 years in prison and fined Ksh 3 million after being convicted of multiple offenses, including child pornography, sexual communication with a child, indecent acts with a child, and child abuse. The verdict was delivered by the Milimani Children’s Court on Tuesday, March 4.

The Office of the Director of Public Prosecution (ODPP) confirmed the suspect was found guilty of 10 charges, which included six counts of child pornography, two counts of sexual communication with a child, one count of indecent acts with a child, and one count of child abuse. These crimes occurred between April 2022 and November 2023.

The accused was found to have shared obscene audiovisual materials with a 17-year-old minor through WhatsApp, with the intention of encouraging the minor to engage in sexual activities. He was also found guilty of convincing a 16-year-old minor to communicate with him in a sexual manner. Furthermore, the court discovered that the accused had indecently touched the private parts of the same 16-year-old, sexually abusing him on the same bed where the victim’s mother—who was in a relationship with the accused—was also present.

The suspect was also found to have pressured another victim, identified as PW3, to engage in sexual acts with underage girls, even instructing him to take explicit photos and videos of these acts, which were then sent to him.

The case was supported by the testimony of nine witnesses. In her judgment, Honorable Alice Macharia emphasized that the evidence was overwhelming and that each charge had been proven beyond a reasonable doubt. She particularly highlighted the emotional testimony of PW3, who spoke of the deep pain caused by the accused’s actions.

In addition to the 10-year prison sentence, the court ordered the suspect to pay Ksh 3 million in restitution to the victims. After serving his sentence, the suspect will be deported from Kenya.

This case highlights the country’s commitment to protecting children from exploitation and the severe consequences for those who engage in such crimes.
