The High Court has issued a new ruling that blocks any attempt to arrest or prosecute Kiambu Governor Kimani Wamatangi, offering him temporary legal protection as a corruption case against him continues.
Justice Chacha Mwita granted a conservatory order that prevents both the Office of the Director of Public Prosecutions (ODPP) and the Ethics and Anti-Corruption Commission (EACC) from arresting or charging the governor while the matter is still being heard in court.
“In the meantime, a conservatory order is issued, stopping the respondents from arresting or taking the petitioner to court based on investigations in this case until September 18, 2025,” said the judge in his ruling.
This means Governor Wamatangi will not face arrest or charges related to the alleged corruption in his administration until the court reconvenes on September 18 for a decisive ruling. Judges will then determine whether to lift the suspension or allow the legal process to proceed further.
Justice Mwita also noted that the ODPP had not yet made a final decision on whether to formally prosecute the governor, which further justified halting any legal actions at this stage.
With the new ruling in place, Governor Wamatangi is now free to continue with his official functions without the threat of arrest or legal disruption—at least until the court makes a final decision in September.
The case traces back to an incident on April 15, when the EACC conducted a major raid on the governor’s home and office, as part of investigations into suspected misappropriation of public funds and possible conflict of interest within the Kiambu County Government.
Alongside the governor, nine other top county officials were also targeted in the raid. Their homes and offices were searched, and they were taken in for questioning.
However, those arrested dismissed the allegations, saying the investigations were politically motivated and designed to damage Governor Wamatangi’s image.
Governor Wamatangi also condemned the raid, terming it as political harassment. He declared that he would not be intimidated or distracted from his leadership responsibilities and vowed to continue delivering development projects for the people of Kiambu.
