Judicial Operations to Resume Nationwide Amid Security Review at Makadara Law Courts

Martha Koome issues new directive on the operation of courts following Makadara shooting incident

Chief Justice Martha Koome has directed all courts nationwide to resume operations from Wednesday, June 19, 2024, except for the Makadara Law Courts, which will remain closed for a security reassessment following the tragic shooting of Senior Magistrate Monica Kivuti.

In a statement issued on Monday, CJ Koome emphasized the importance of continuing judicial functions while addressing the necessary security improvements.

“Consequently, courts nationwide will proceed with their operations on Wednesday, 19th; Thursday, 20th; and Friday, 21st; except for Makadara Law Courts, which is under re-evaluation for security purposes,” she stated.

Security Enhancements Across Court Premises

CJ Koome assured that comprehensive security measures are being implemented in collaboration with the police.

“I have spoken with the Inspector General of Police, who has assured that security in our court premises and for judges and judicial officers nationwide has been enhanced,” she said.

Despite the increased security, CJ Koome acknowledged that ongoing internal consultations and engagements with government agencies are crucial for identifying and mitigating any security gaps.

“We will continue to engage internally and with other relevant government agencies and stakeholders to comprehensively address identified security gaps,” she noted.

Special Focus on Makadara Law Courts

The Makadara Law Courts, the site of the fatal shooting of Magistrate Kivuti by Chief Inspector Samson Kipchirchir Kipruto, remains under scrutiny.

The attack, which resulted in Kivuti’s death and injuries to three other officers, has led to a re-evaluation of security protocols at the facility.

The judiciary has deemed it necessary to keep the Makadara courts closed while security measures are reassessed and enhanced to prevent similar incidents.

Virtual and Alternative Court Operations

In light of the ongoing security review, CJ Koome highlighted the judiciary’s commitment to maintaining operations through alternative means.

Judges, judicial officers, and staff are encouraged to use virtual courts and secure permanent court locations as needed to ensure the continuity of judicial services.

However, the judiciary also faces internal challenges. On Saturday, June 15, 2024, judicial officers, including judges, magistrates, and kadhis, announced a go-slow in protest of poor working conditions and inadequate security measures.

The protest was planned to coincide with the resumption of court operations on June 19, signaling their dissatisfaction with the current state of affairs and calling for immediate action to address their concerns.
