Ferdinand Waititu Faces New Criminal Charges While Serving Jail Term

Former Kiambu Governor Ferdinand Waititu’s legal troubles seem far from over, as he now faces a new set of criminal charges even while behind bars.

On Tuesday, November 11, the once-powerful county boss was hit with fresh charges, adding to his long list of court battles.

Waititu, who is currently serving a 12-year prison sentence for corruption-related offences, was charged over statements he allegedly made during a public rally at Ruiru Stadium in Kiambu County on September 29, 2024.

Prosecutors claim that his remarks during the event were provocative and had the potential to stir public unrest across the country.

According to court documents, the former governor reportedly condemned the impeachment proceedings against former Deputy President Rigathi Gachagua by saying, “If Gachagua goes home, then President Ruto must also go.”

The prosecution argued that this statement was inflammatory and specifically targeted groups such as hustlers, market traders, boda boda riders, and members of the clergy, with the intention of creating division and tension among citizens.

Prosecutors noted that Waititu’s remarks violated Section 94(1) of the Penal Code, which prohibits speech or behavior likely to cause public disorder or disturb the peace. The Office of the Director of Public Prosecutions (ODPP) confirmed that it would pursue the matter fully, and a hearing has already been scheduled for next week.

Waititu is currently being held at Kamiti Maximum Prison, where he is serving his sentence after being found guilty of conflict of interest and handling suspect property during his time as Kiambu Governor.

His conviction also came with a 10-year ban from holding public office, effectively ending his political career for the foreseeable future.

Despite his imprisonment, Waititu and his legal team have repeatedly tried to secure his release. In September 2025, his lawyers made another attempt to appeal for his freedom, but the High Court rejected the request, citing his failure to provide the required bank guarantee.

This was not the first time such an attempt was made; the court noted that similar applications had been filed on three previous occasions and were all dismissed.

High Court Judge Lucy Njuguna, who presided over the case, ruled that continuous appeals without proper grounds were only meant to delay justice.

Earlier in February, after his conviction, Waititu had been granted temporary relief when he was freed on a Ksh53 million bond pending the hearing of his appeal. However, that relief was short-lived as the appeal failed to overturn his sentence.

The former governor’s situation paints a grim picture of a once-influential political figure who has faced multiple legal setbacks.

As he prepares for yet another court battle over his alleged inciteful speech, it remains to be seen whether the new charges will add to his existing troubles or open another chapter in his long fight with the law.
