Inspector General of Police Douglas Kanja and DCI Director Amin Mohammed have once again failed to physically appear in court regarding the ongoing case of three missing youth from Mlolongo.

The two senior police officers were summoned in connection with the alleged abduction of Justus Mutumwa, Martin Mwau, and Karani Muema, who were reported missing on December 16, 2024.

On Friday, instead of attending the court session in person, Kanja and Amin, through their lawyer Paul Nyamodi, submitted an application seeking to have the court orders requiring their physical appearance set aside.

Nyamodi argued that the orders issued on January 8 and reaffirmed on January 13, 2025, were invalid since his clients had not been properly served.

He stressed that proper service is a critical part of legal procedures, citing Order 5 of the Civil Procedure Rules, which specifies that not just anyone can serve court documents.

However, the petitioners, who are representing the families of the three missing youth, opposed Kanja and Amin’s application, maintaining that the officers were served correctly through electronic means, which is legally recognized in court proceedings.

They further emphasized that public interest demands the personal appearance of the Police IG and DCI chief, especially in cases involving threats to life, adding that security agencies must be held accountable when lives are at risk.

Justice Chacha Mwita stated that the court would issue a ruling next Thursday on whether Kanja and Amin were properly served and are required to attend court physically.

Meanwhile, the judge upheld the order directing the two senior officers to produce the missing individuals, dead or alive, pending the full hearing of the case.

Additionally, the court was informed that the families of the missing youth initially faced challenges accessing the courtroom.

It was only after the intervention of the deputy registrar that they were allowed entry.

Lawyer Dan Maanzo expressed disappointment over the incident, stating, “We were shocked when family members were blocked from entering the courtroom by police officers who claimed they had instructions from higher authorities not to let them in.”
