Boda Boda Riders Warn of Nationwide Protests

The Boda Boda Safety Association of Kenya (BSAK) has issued a warning that they will hold a nationwide strike if the National Assembly goes ahead with the Public Transport (Motorcycle Regulation) Bill 2023.

The Bill has already been approved by the Senate, and it proposes stringent regulations, including a limit on the weight of luggage carried by motorcycles.

According to the proposed legislation, no motorcycle should carry a load that exceeds 50 kilograms, or one that is taller than two meters from the ground, or wider than 15 centimeters beyond the handlebars.

The Bill, which is sponsored by Kakamega Senator Boni Khalwale, has sparked strong opposition, especially from boda boda riders, who view it as an attack on their livelihoods.

Speaking exclusively to newshub.co.ke on Friday, February 21, BSAK National Chairman Kevin Mubadi said that while they do not oppose the Bill, they want their voices to be heard and their concerns taken into account.

“We are not against the Bill itself, but we just want to be invited to share our opinions and contribute to the discussion,” Mubadi explained.

He went on to argue that the proposed regulations were unfair to boda boda riders, many of whom are struggling to make a living.

The debate surrounding the Bill has intensified, with several controversial provisions now at the center of attention. One of the most disputed clauses proposes a Ksh20,000 fine for anyone caught riding on a pedestrian walkway, which has raised concerns within BSAK.

“A Ksh20,000 fine is unreasonable because we don’t earn that much,” Mubadi added.

The Bill also mandates that all motorcycles must have a minimum of a commercial public service vehicle insurance cover and a security device approved by the county executive committee member. Additionally, riders are prohibited from carrying unauthorized goods, including contraband such as illegal drugs or firearms, as specified in the Narcotic Drugs and Psychotropic Substances (Control) Act and the Firearms Act.

Mubadi issued a stern warning to Members of Parliament, saying that if the strike goes ahead, it would bring transport to a standstill across the country. He urged MPs to take the strike threat seriously and listen to the concerns of boda boda riders.

At this stage, BSAK has not disclosed the specific date for the planned protests, as they are still awaiting a decision from the National Assembly.

However, they have expressed hope that they will be given the opportunity to voice their concerns before the situation escalates into a full-blown strike.
