JSC Nominates Justice Mohamed Abdulahi Warsame for Supreme Court Appointment

The Judicial Service Commission (JSC) has officially nominated Justice Mohamed Abdulahi Warsame for appointment to the Supreme Court of Kenya. His name has now been forwarded to President William Ruto for the final step of appointment, as required under the Constitution.

Chief Justice Martha Koome confirmed the nomination, stating that the JSC had completed its selection process and was satisfied with Justice Warsame’s suitability for the apex court.

“I am therefore pleased to announce that the Judicial Service Commission has nominated the Honourable Mr Justice Mohamed Abdullahi Warsame for appointment to the Supreme Court of Kenya,” said Chief Justice Koome.

Final Step Now with the President

Under Article 166(1)(b) of the Constitution of Kenya, Supreme Court judges are not appointed directly by the President alone.

Instead, the process requires the Judicial Service Commission to recommend a candidate first, after which the President formally appoints the nominee through a Gazette Notice.

This means Justice Warsame’s appointment is now awaiting formal approval and official announcement by President William Ruto.

Strong Judicial Background

Justice Mohamed Abdulahi Warsame brings with him many years of experience in Kenya’s judiciary. Before his nomination to the Supreme Court, he had been serving as a judge of the Court of Appeal since 2012, one of the highest courts in the country.

Prior to that, he worked in the High Court, where he handled different divisions including the Commercial Division and the Criminal Division. He also served in the Judicial Review Division, which deals with cases challenging government decisions and actions.

Over the years, Warsame has built a reputation as a seasoned judge with extensive experience in constitutional, commercial, and criminal law matters.

Education and Legal Training

Justice Warsame holds a Bachelor of Laws (LLB) degree from the University of Nairobi. He also completed his Diploma in Law at the Kenya School of Law, which is a mandatory professional training institution for legal practitioners in Kenya.

His academic and professional background has contributed to his long career in the judiciary, rising through the ranks from the High Court to the Court of Appeal, and now being considered for the highest court in the land.

Filling a Vacancy in the Supreme Court

If formally appointed, Justice Warsame will join the Supreme Court bench, which is made up of Chief Justice Martha Koome,

Deputy Chief Justice Philomena Mwilu, and other judges including Justice Mohammed Ibrahim, Justice Smokin Wanjala, Lady Justice Njoki Ndung’u, Justice Isaac Lenaola, and Justice William Ouko.

He is expected to take up the position left vacant by the late Judge Mohamed Khadhar Ibrahim, who passed away in December last year at the age of 69. His death came just weeks before his expected retirement from the judiciary.

Immediate Nomination After Interview

Reports indicate that Justice Warsame was among the final candidates interviewed by the JSC panel on Wednesday, April 29. Interestingly, his nomination came just hours after completing his interview, showing the Commission’s confidence in his experience and qualifications.

Following the announcement, Chief Justice Koome stated that the nomination has already been transmitted to President William Ruto for formal appointment in line with Article 166(1A) of the Constitution.
